## Plays That Work

**In short:** 5 outbound plays for lawyers, each tied to a trigger you can spot.

**Outbound plays for lawyers**

| Play | Channel | Trigger | Angle | Example first line |
| --- | --- | --- | --- | --- |
| Funding round closed | Email and LinkedIn | The company announced a priced round, or a new Form D filing for it appears on the SEC's EDGAR database. | Write to the CEO after a seed or Series A round about the corporate work that follows: board consents, option grants, investor rights and diligence for the next round. | Congrats on the round; the work after closing, like option grants, board consents and a clean cap table, is where [Company] will want outside counsel lined up. |
| Hiring in a new state | Email | Job postings appear for roles based in a new state, or the company announces an office there. | Write to the HR Director when the company starts hiring in a state where it has no employees, about state-specific handbooks, leave rules and offer letters. | [Company] just posted its first roles in a new state, and each new state brings its own leave, pay and handbook rules to review before those offers go out. |
| New lease or facility | Email | The company announced a new headquarters, plant or office, or the local business press reported a lease in negotiation. | Write to the COO or CFO when a company announces a move or expansion, about reviewing and negotiating the lease before signing. | If [Company]'s new office lease is still in negotiation, the renewal, assignment and restoration clauses are worth a review before you sign. |
| Trademark filed without counsel | Email | USPTO records show a new trademark application with no attorney of record. | Write to the founder of a company that filed a trademark application on its own, about office action responses and clearance in the other markets it sells in. Check your state's rules on targeted written solicitations before you send this one. | [Company]'s new trademark application shows no attorney of record, and if the examiner issues an office action, we can draft the response and check clearance in your other markets. |
| First general counsel search | Email | The company posts a job for its first general counsel or in-house counsel. | Write to the CEO or CFO when the company is hiring its first in-house lawyer, and offer to cover contracts and employment work at a fixed monthly fee during the search. | While [Company] looks for its first general counsel, the contract queue does not stop, and we can cover it at a fixed monthly fee until your hire starts. |

## Campaigns or 1:1 Accounts?

**In short:** With 522,335 buyers and a typical deal of $3,680-$18,400 (estimate), volume outbound in Campaigns fits best.

**Lane check for lawyers**

| Check | Lawyers | Points to Accounts (Coming) when |
| --- | --- | --- |
| Typical deal (estimate) | $3,680-$18,400 (first-year legal fees from one business client), midpoint $11,040 | Over $15,000 |
| Buyer companies in Ken's database | 522,335 | Fewer than 25,000 |
| Suggested lane | Campaigns | Both checks pass |

Ken's estimate: 10-50 hours of business legal work in the first year at $368 an hour, the 2025 median rate for full-time private practitioners in the State Bar of Texas survey.

Ken's view: when one deal is worth more than $15,000 and there are fewer than 25,000 buyers, each account is worth researching and writing to one by one. Otherwise volume wins: a Campaign of short email and LinkedIn sequences reaches more of the market for the same effort.

## Objections

**In short:** What buyers tend to say back to lawyers, and how to answer.

**Objections lawyers hear from buyers**

| Objection | How to answer |
| --- | --- |
| We already have outside counsel. | Keep them for the work they know. Send us one contract review or employment question they have not gotten to, and compare the turnaround and the bill. |
| Our general counsel handles it in-house. | Good, then you need less from us. We work under your GC on overflow, like a lease review or a multi-state handbook update, at a fixed fee they can budget. |
| Lawyers are too expensive for this. | Ask us for a fixed fee on one defined piece of work, like a lease review or an option plan, so you know the cost before we start. |

## FAQ

### How do lawyers get clients?

In Ken's view, for business lawyers, referrals from other lawyers, accountants, bankers and existing clients are the usual source. Outbound adds companies at the moment they need counsel: after a financing, a move into a new state, a new lease or a trademark filing.

### Are lawyers allowed to send cold email?

ABA Model Rule 7.3 restricts live, person-to-person solicitation. As the ABA Journal summarizes it, even that is allowed with a person who routinely uses the type of services the lawyer offers. States adopt their own versions and they differ: Minnesota's rule keeps that business-use exception and says text messages and other written communications that recipients may easily disregard are not live contact, while Pennsylvania's has no business-use exception and counts text messages as live contact. Some states also add requirements for targeted written solicitations, so read your state's rule and bar opinions before you send. This is general information, not legal advice.

### Who should a business law firm email at a company?

At companies without in-house counsel, the CEO or COO usually picks outside counsel, so write to them. Once a company has a general counsel, that person owns the outside firm list. For employment work, the HR Director is often the first to feel the problem.

### Can I use outbound for personal injury or family law?

This page covers business law sold to companies only. Personal injury and family law clients are individuals, not companies, so the buyer counts and plays here do not apply to them.

### What does the CAN-SPAM Act require of a cold email?

In the US, the CAN-SPAM Act covers commercial email, and the FTC says it makes no exception for business-to-business email. Its requirements: no false or misleading header information, no deceptive subject lines, identify the message as an ad, include your valid physical postal address, tell recipients how to opt out, honor opt-outs within 10 business days, and monitor anyone who sends email on your behalf. Other countries have their own rules. This is general information, not legal advice.
